• Main activity: artificial intelligence research laboratory (CNAE 7210). Development and marketing of the AiKit platform, a SaaS artificial intelligence service aimed at SMEs and self-employed professionals. In addition, AIKIT RESEARCH manages advisory services and the processing of public aid programmes for digital transformation through AI.

This Legal Notice governs access to, browsing of, and use of the websites operated by AIKIT RESEARCH, S.A. (hereinafter, the “Portals”).

Access to the Portals confers the status of user (hereinafter, the “User”) and entails full acceptance of all the provisions set out in this Legal Notice in the version published at the time of access.

Access to the Portals is free of charge, without prejudice to the cost of connecting to the telecommunications network. The contracting of AIKIT RESEARCH, S.A.'s services is governed by:

• For the AiKit SaaS platform: the Platform Terms of Use and, where applicable, the Data Processing Agreement (DPA).
• For the Plan IA Empresarial campaign: the Terms of the Plan IA Empresarial 2025 and, where applicable, the Terms of the AIKIT GRANT SERVICES Integrated Management Service.

These specific documents are available on the corresponding portal.

All contents of the Portals, including text, images, graphic design, source code, logos, trademarks (such as “AiKit”) and other elements, are the property of AIKIT RESEARCH, S.A. or of third parties who have authorised their use, and are protected by Spanish and EU legislation on intellectual and industrial property.

Access to the Portals does not grant the User any exploitation right over such contents. Their reproduction, distribution, public communication, transformation or any other form of exploitation is prohibited without the express written authorisation of AIKIT RESEARCH, S.A.

The User undertakes to make proper use of the Portals in accordance with the law, this Legal Notice and good practice. In particular, the User agrees to:

• Not use the Portals for unlawful purposes or for purposes harmful to the rights and interests of AIKIT RESEARCH, S.A. or of third parties.
• Not reproduce, copy, distribute, publicly communicate, transform or modify the contents of the Portals without express authorisation.
• Not introduce or disseminate computer viruses or any other system that may cause damage to the systems of AIKIT RESEARCH, S.A. or of third parties.

5.1. Regarding information: the contents of the Portals are of a general and informative nature. They do not in any case constitute professional, technical, legal or financial advice. AIKIT RESEARCH, S.A. shall not be liable for decisions made on the basis of the information provided on the Portals.

5.2. Regarding availability and continuity: AIKIT RESEARCH, S.A. does not guarantee the availability or continuity of access to the Portals, nor the absence of viruses or other harmful elements. It is the User's responsibility to have suitable tools for their protection.

5.3. Regarding third-party links: the Portals may include links to third-party websites. AIKIT RESEARCH, S.A. shall not be liable for the contents or services supplied on such linked sites (Art. 17 LSSI-CE).

The processing of personal data collected through the Portals is governed by our Privacy Policy. The contracting of the AiKit SaaS platform is additionally subject to the Data Processing Agreement (DPA). The management of public aid is subject to the Terms of the Plan IA Empresarial 2025 and of AIKIT GRANT SERVICES. All these documents are available on the Portals.

This Portal is governed by the following regulations, among others:

• Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).
• Regulation (EU) 2016/679 (GDPR), General Data Protection Regulation.
• Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).
• Regulation (EU) 2024/1689 (AI Act) of the European Parliament and of the Council, laying down harmonised rules on artificial intelligence.

This Legal Notice is governed by Spanish law. For any dispute arising from access to or use of the Portals, the parties submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, with express waiver of any other jurisdiction that may correspond to them.

This submission to jurisdiction shall not apply where the User holds the legal status of consumer, in which case the courts of the User's domicile shall have jurisdiction.
